Aboveground Tank in West Virginia

The recent passage of Senate Bill 373, which includes the Aboveground Storage Tank Act §22-30 and the Public Water Supply Protection Act §22-31, has created several new requirements for Aboveground Storage Tank (AST) owners in West Virginia.

Besides the requirement to register tanks by October 1, 2014, owners are also required to submit a Spill Prevention Response Plan (SPRP) by December 3, 2014. All tanks over 1,320 gallons and all secondary containments must be inspected and evaluated by a Professional Engineer (P.E.) or an API Certified Inspector prior to January 1, 2015. These expanded legal requirements have profound difficulties for many tank owners to meet the short deadlines.
